Welcome to Streamty! Please carefully read these Terms of Service ("Terms") before accepting them. By using Streamty's services, you agree to these Terms and other included terms and policies by reference.
These Terms are available on our website, www.streamty.pro (the "Website"), in electronic format. The Terms were last updated on 01.11.24.
By using Streamty, you also acknowledge that you have read and agreed to the YouTube, TikTok, Twitch, Kick, Instagram, Facebook Terms of Service. If you do not accept these Terms, you are not permitted to use our services.
User Agreement
- 1.1. As a User ("you"), by accessing Streamty's services, you agree that:
- 1.1.1. You are at least 18 years old or have obtained the consent of a parent or legal guardian.
- 1.1.2. If using Streamty on behalf of a company, you have the proper authority to accept these Terms on the company's behalf.
Definitions
- 2.1. Software: The "Streamty" software, provided by the Company to the User based on these Terms and the selected Subscription.
- 2.2. Content: Copyright-protected intellectual property created or uploaded by the User, including audiovisual works, music, and other creative materials.
- 2.3. Platform: The integrated software and hardware provided for storing, streaming, and distributing Content, displaying ads, and collecting statistical information.
- 2.4. Balance: The User's virtual account within the Software for payments related to the Services. Balance funds are non-withdrawable and are used solely within the platform.
Services, Privacy Policy, Account Registration
- 3.1. The Company offers infrastructure for content hosting and data processing through the Software.
- 3.2. To use the Services, you must create an account. By creating an account, you agree to:
- 3.2.1. Provide accurate and current information.
- 3.2.2. Maintain the security of your password and account.
- 3.2.3. Promptly update your information and protect your Registration Data.
- 3.3. The Company is not responsible for any loss resulting from failure to meet these responsibilities. All actions under your account are your responsibility.
- 3.4. You also confirm that you agree with the Company’s Privacy Policy. If you disagree with the Privacy Policy, you may not use the Services.
Intellectual Property Rights
- 4.1. The Company grants a limited, non-exclusive, non-transferable license to use the Software for accessing and using the Services.
- 4.2. Users may not:
- 4.2.1. Copy, distribute, modify, or create derivatives of the Software.
- 4.2.2. Decompile or reverse engineer the Software.
- 4.2.3. Lease, sublicense, or resell the Software.
- 4.3. The Company does not claim ownership over User Content and provides tools solely for private usage. The Company has no license over or responsibility for User-uploaded content.
Warranties and Liability
- 5.1. Users are responsible for the accuracy of their account information and compliance with payment obligations.
- 5.2. Additionally:
- 5.2.1. Users agree to settle any third-party claims related to their use of the Services within 30 days of notification.
- 5.2.2. Users shall not disrupt the functionality of the Company’s Software or services.
- 5.3. The Software is provided on an "as-is" basis. The Company disclaims all warranties, express or implied, including those of merchantability, fitness for a particular purpose, and non-infringement.
- 5.4. The Company is not liable for indirect, incidental, or punitive damages arising from the use of the Software.
- 5.5 - 5.9. Additional clauses related to third-party service dependencies, limitation of liability, and user compensation requirements.
Subscription, Trial Period, and Payment
- 6.1. Creating an account grants a 1-day trial period ("Trial Period") with access to Streamty’s services.
- 6.2. After the Trial Period, subscription fees apply as per the chosen plan. Subscription renews automatically unless canceled before renewal.
- 6.3 - 6.5. Payment methods, tax obligations, refund policy, and plan upgrade options.
Communication
- 7.1. By using Streamty, you consent to receive transactional and service-related communications.
- 7.2. Legal communications will be sent electronically, fulfilling written notice requirements.
Modifications and Termination
- 8.1 - 8.3. The Company may change these Terms and assign rights to third parties without prior consent. Continued use of the Services after a change signifies acceptance.
Prohibited Conduct
By using the Software, you confirm that you will not engage in any unlawful activities or fraudulent practices. The Company reserves the right to suspend accounts or cancel subscriptions for policy violations.
